The state of Florida handles child custody matters differently than other states. Rather than awarding child custody to one parent and visitation rights to the other, Florida law now uses a parenting plan to establish time-sharing, decision-making ability and other considerations with regard to parenting.

Parenting plans can either be agreed to by the parents and approved by the court, or the court may create one for the parents if an agreement was not previously reached. Generally speaking, it is better for the parents to agree on a plan rather than to let the court decide. When each parent has an equal say in the details of the plan, child custody matters tend to be less controversial.
